La mort en droit civil (I)
Résumé
Pour beaucoup de gens, la mort est l’horreur absolue ; elle met fin à la vie et
fait du corps humain une chose. Pour ceux qui croient en la Résurrection, elle est
une vie nouvelle. Notre société essaye de la faire disparaître du paysage familial
et quotidien.
Après la mort, la personnalité juridique disparaît, et l’individu cesse d’être sujet
de droit. Or le Code civil ne donne aucune définition à la mort ; il serait, en effet,
périlleux d’imposer une définition légale rigide sur une question qui ne peut être
résolue que par un diagnostic individuel. Ainsi, deux questions se posent au
juriste: comment prouver la mort et comment la définir?
Cet étude cherche de répondre à ces questions à travers l’histoire et le
présent.
Pour acquérir un droit d’un mort, il ne suffit pas que cette personne soit morte,
il faut le prouver. La preuve de la mort se résout faisant appel à la médecine; elle
pose des problèmes moraux, notamment en ce qui concerne l’acharnement
thérapeutique et l’euthanasie.
La question de la définition est infiniment plus délicate, pour la raison
principale que les progrès de la médecine ont considérablement modifié notre
perception de la mort.
1. Preliminarii
Sfârşitul capacitãţii de folosinţã este fixat în momentul morţii care – dupã cum
spunea Malraux – „schimbã poate viaţa în destin” dar face din corpul uman un lucru.
Moartea este – ca fenomen individual – rãul absolut, poate nu atât pentru mort cât
pentru rudele sale şi pentru cei care l-au iubit. Moartea înseamnã a nu mai fi. Ea ne
duce în nefiinţã şi ne apropie de toate lucrurile care au încetat a mai fi. Vom afla
astfel cã întreaga viaţã este un zbor intens spre nefiinţã, un moment de luminã
înainte de moartea ce ne va apropia de adevãratul înţeles al lucrurilor şi a valorii lor1.

The alea Element in Contracts Concluded on the Capital Market
Summary
The above study aims at determining if any of the contracts dealt on the
capital market presents the characteristic of being aleatory (aleatorius).
The general legal Romanian framework is Law no. 297 of 2004 on capital
market, but it is not very specific on the issue. Therefore, we have tried to provide
a short analysis of the mechanism of dealing contracts considering the speculative
intentions (causa remota) of the parties regarding the various types of securities
transactions: typical securities sales on primary and secondary market, futures
and forward contracts, options, swaps, hedging, repo and reverse repo contracts,
margin tradings, short sales.
In conclusion, sales of the derivative financial instruments are mainly aleatory.
The same particularity defines also the repo contracts and the margin tradings.
1. Aspecte introductive
Legea nr.297/2004 privind piaţa de capital1 a abrogat O.U.G. nr.28/2002 privind
valorile mobiliare, serviciile de investiţii financiare şi pieţele reglementate2, fãrã a
reitera expres reglementarea cu valoare de principiu ce era cuprinsã în art.45 din
acest din urmã act normativ: „Orice tranzacţie efectuatã pe o piaţã reglementatã şi
înregistratã în conformitate cu reglementãrile specifice acesteia, este act de comerţ
şi dã naştere unei obligaţii valabile, cãreia nu i se poate opune excepţia de joc”3.

Comparative View on the Civil Actions’ Classification
Summary
A system of justice is essential to the maintenance of a civilized society. The
law itself provides the basic structure within which commerce and industry operate.
It safeguards the rights of individuals, regulates their dealings with others and
enforces the duties of Government. The administration of civil justice plays a role
of crucial importance in maintaining this structure.
Effective access to the enforcement of rights and the delivery of remedies
depends on an accessible and effective system of civil litigation.
Pleadings should enable the court and the parties to identify and define the
issues in dispute, in particular enabling the court to direct summary trial of specific
issues and to limit the matters, which will eventually need to be tried. They should
also enable the court to make decisions about such matters as the appropriate
case management track and venue.
Clasificarea acţiunilor nu are doar o importanţã teoreticã, de structurare şi stabilire
a unor criterii, ci şi o însemnatã importanţã practicã. Prin încadrarea unei acţiuni
într-o categorie sau alta se stabilesc aspecte tehnico-practice ale desfãşurãrii
activitãţii procesuale de judecatã, începând cu instanţa competentã sã soluţioneze
litigiul şi terminând cu finalitatea acţiunii sub forma executãrii silite.
În cele ce urmeazã vom oferi, într-o încercare de sistematizare, principalele
criterii de clasificare şi acţiunile corespunzãtoare acestor criterii, urmând sã analizãm
apoi cele mai importante acţiuni civile şi aplicaţiile lor practice.
Un prim criteriu de clasificare are în vedere scopul procesual urmãrit1. Pentru
aceeaşi clasificare am întâlnit şi formularea scopul material urmãrit de reclamant2
sau scopul reclamantului şi natura soluţiei3.
În funcţie de aceste repere, acţiunile civile se clasificã în:
a. acţiuni în realizarea dreptului;

The Seeming Mandate
Summary
This article deals with the necessary legal conditions of the seeming mandate.
The mandator is compelled to fulfil all obligations the mandatary took on his
behalf if the powers he vested him were respected.
The mandator is not compelled to fulfil those obligations the mandatary took
on his behalf if the powers he vested him were not respected. In such situations,
if a seeming mandate could not be proved, those acts exceeding the mandate
could not legally bind the mandator, although he could be held responsible. The
legal basis is different, being the affair administration or the enrichment without
legal basis, instead of the mandate contract.
In those situations in which the mandatary acted with the free consent of the
mandator in order to create a false image to the third parties, it shall apply the
theory of apparence, which corresponds to the latin principle “error communis
facit jus”.
The theory of the seeming mandate implies the following conditions, directly
related with the theory of apparence, as follows:
a. The objective element consisting in a seeming mandate but, in reality, the
lack of representative powers of the mandatary;
b. A subjective element consisting in the legitimate, but wrong, faith of the
third parties in the apparence created and the real situation. The third parties’
good faith must be legitimate.
c. The existence of a prejudice, for the third parties, if the seeming situation
created is left without juridical effect;
d. The mandator must not know this situation. If he knew the existence of a
seeming mandate, there will be no legal effects for him.
Deşi majoritatea lucrãrilor de specialitate care se referã la contractul de mandat fac referire şi la mandatul aparent, precum şi la efectele acestuia, o sistematizare a condiţiilor pe care trebuie sã le îndeplineascã acesta se pare cã lipseşte, aşa încât demersul nostru are acest obiectiv, cu scopul de a ajuta la o mai bunã înţelegere şi aplicare a teoriei mandatului aparent. Relativitatea contractului de mandat. Un contract este destinat, în principiu, sã producã efecte doar între pãrţi. În general, el nici nu profitã terţilor şi nici nu-i prejudiciazã. O spune în mod clar şi concis art. 973 C. civ.: „Convenţiile n-au efect decât între pãrţile contractante”. Aceastã regulã se aplicã şi atunci când una din pãrţi nu a încheiat actul personal, ci prin intermediul unui reprezentant, în cazul

Zusammenfassung
Die Vertretungstheorie, bereits im XIX Jahrhundert kristallisiert, zeigt sich im folgenden als extrem interessant aufgrund der 2 Elemente die ihr Rechtsregime prägen, und zwar: die Macht, die dem Vertreter erteilt wird, und die Ausübung dieser Macht. Die Quelle der Vertretungsmacht, obig festgelegt, stellt den schlüssel für die Erläuterung der Vertretung dar.
Din perspectiva adoptãrii unei reglementãri cu caracter general1, evocarea
regimului juridic al acestei construcţii2 apare ca un exerciţiu necesar.
Teoria reprezentãrii (die Vertretung, la rappresentanza), cristalizatã încã din secolul
al XIX-lea3, se dovedeşte în continuare extrem de interesantã, din cauza celor douã
elemente care dominã regimul ei juridic, şi anume: puterea conferitã reprezentantului
şi exerciţiul acestei puteri.
Absenţa codificãrii, specificã dreptului francez, a permis doctrinei sã construiascã
o teorie celebrã din cauza originalitãţii ei, extrem de practicã şi utilã din cauza
efectelor ei4, spre deosebire de omologul german, unde dezbaterile doctrinare s-au
tradus prin adoptarea în BGB a unor dispoziţii specifice5. Începând cu Germania,
aceastã idee de autonomie a reprezentãrii a progresat, fiind inclusã în codificãrile
mai multor state, cum ar fi Elveţia6 sau Italia7.

Quelques considérations sur l’historique, la notion etla nature juridique de l’expropriation pour cause d’utilité publique
Résumé
L’expropriation est la procédure qui consiste à contraindre le propriétaire d’un bien immobilier à le céder à la commune. Ce transfert de propriété doit être justifié par un intérêt public et donne lieu au versement d’une indemnité. La procédure comprend une phase administrative et une phase judiciaire, à moins que la cession ne soit amiable. Le sujet de cet article est l’histoire legislative de la procedure de l’expropriation en Roumanie, histoire qui commence a 20 oct. 1864 et aussi la notion et la nature juridique de l’expropriation pour cause d’utilité publique dans le droit civil roumain. En Roumanie l’expropriation, fait objet d’etude pour le droit civil – les biens – et elle est reglementée comme un procedure exceptionelle, une resrainte au droit absolu et inviolable du proprietaire.
1. Istoria legislativã a exproprierii, în România1, putem spune cã începe la 20
octombrie 1864 când se adoptã, dupã modelul legii franceze din 3 aprilie 1841,
Legea de expropriaţiune pentru cauzã de utilitate publicã care a reuşit sã producã
efecte aproape 100 de ani, pânã la data abrogãrii sale exprese.
Apoi, nu este de trecut cu vederea nici data de 16 decembrie 1864, datã la care
este adoptat Codul civil român, o monumentalã lucrare legislativã în vigoare în cea
mai mare parte şi astãzi, ale cãrui principale surse de inspiraţie au fost Codul civil
francez şi cel italian. Acesta vorbind la art.480 despre proprietate, aratã în articolul
imediat urmãtor cã: „nimeni nu poate fi silit a ceda proprietatea sa, afarã numai pentru
cauzã de utilitate publicã, primind o dreaptã şi prealabilã despãgubire”. Aceste dispoziţii
apar cu atât mai importante cu cât ne raportãm la contextul istoric al adoptãrii
acestui act normativ, respectiv apariţia sa la numai cinci luni de la adoptarea de
cãtre Consiliul de Stat a legii rurale, lege însoţitã de o Proclamaţie în care se putea...

The Birth of the Natural Person Between Publicity and Anonymity
Summary
The purpose of this article is to provide a brief analysis of the birth of the
natural person. The issue is broached from the point of view of the Romanian
legislator, as well as from the one of the French legislator. The latter regulates the
possibility of giving birth under the protection of the anonymity, procedure called
„accouchement sous X”.
„Accouchement sous X” is also presented and described from a historical
point of view, since it has been known (in France) since the Middle Ages.
The birth of the natural person is thus analysed and placed between publicity
and anonynimity.
1. Reglementarea actualã în dreptul intern
Naşterea persoanei fizice, ca fapt de stare civilã, genereazã obligaţia întocmirii
actului de naştere a acesteia.
Actul de naştere al copilului se întocmeşte pe baza declaraţiei verbale, declaraţie
datã în faţa ofiţerului de stare civilã competent de la primãria municipiului, de la cea
a sectorului din municipiul Bucureşti sau de la cea a comunei ori oraşului în raza
cãruia a survenit naşterea.
Persoanele care au obligaţia de a face aceastã declaraţie, conform art. 19 din
Legea nr. 119/1996 care reglementeazã actele de stare civilã, sunt pãrinţii, iar dacã
aceştia nu o pot face, naşterea va fi declaratã de medicul care a asistat la naştere
sau de cãtre personalul sanitar, de rudele şi vecinii care au aflat despre naşterea
copilului respectiv.
Declaraţia privind naşterea copilului trebuie, conform legii, însoţitã de urmãtoarele
acte: certificatul medical constatator al naşterii; certificatul de naştere şi actul de
identitate al mamei şi al declarantului, dacã naşterea nu este declaratã de cãtre
mamã; certificatul de cãsãtorie al pãrinţilor copilului, în cazul în care aceştia sunt
cãsãtoriţi.
NOUA NOŢIUNE A IMOBILULUI ÎN DETERMINAREA OBIECTULUI CÃRŢII FUNCIARE

Le nouvelle notion de l’immeuble definie par le Loi no.7/1996
Résumé
Cette étude est dédiée à une nouvelle notion de l’immeuble telle quelle est
définie par l’article 1 de la Loi no.7/1996, modifiée.
Dans l’actuelle forme de réglementation, apportée par la Loi no.247/2005 on
a renoncé à la création immobilière complexe du corps de propriété ainsi qu’à la
partie cadastrale, reconnaissant à l’immeuble sa valeur en tant qu’entité unique
du système de publicité. Conformément aux dispositions de la Loi, par immeuble
on comprend une ou plusieurs parcelles jointes indifféremment de la catégorie
d’usage, appartenant au même propriétaire qui s’identifie par un numéro cadastral
unique et s’inscrit dans un livre foncier. Dans le prisme de cette définition
l’immeuble peut être formé d’une seule parcelle qui a une certaine catégorie
d’usage, ou de plusieurs parcelles jointes. Dans cette dernière situation chaque
parcelle peut avoir une catégorie d’usage différente mais il est nécessaire que
celles-ci, jointes, appartiennent au même propriétaire, pour que l’immeuble soit
inscrit sous le même numéro cadastral.
L’etude analise des importante aspectes d’abord de modification de
l’immeuble par jonctions, disjonctions et modifications de la superficie.

Das Verhältniss zwischen dem religiösen Zivilrecht und dem orthodoxen kanonischen Recht
Zusammenfassung
Ein sehr wichtiges Problem für die Integration Rumäniens in die EU ist die Errichtung eines entsprechenden rechtlichen Status für die religiösen Kulte. In dem Sinn, braucht Rumänien ein neues Kultusgesetz, das sich jetzt im rumänischen Parlament befindet. Ohne einer freien Ausübung religiöser Gefühle kann man nicht über Demokratie sprechen. In diesem Prozess soll Rumänien seine historische Tradition objektiv und effizient benützen und sein religiöses Recht im europäischen Kontext eingliedern. Man muss zugleich alle möglichen Konflikte, bezüglich vieler Aspekte, zwischen dem religiösen Recht und dem orthodoxen Kirchenrecht, beseitigen, wie z.B.: die Diskrimination, das Eigentumsrecht, der kanonische Status der liturgischen Gegenstände, die doppelte Jurisdiktion, der religiöse Lebensstil, die Finanzierung der Kulte, die religiösen Kennzeichen usw. Die Integration Rumäniens in die EU soll für uns eine Chance sein, um demokratische Gesetze zu veröffentlichen, die der Kirche, den Gläubigen und den Bürger zu Hilfe kommen.

The Romanian Fiscal System and its Fundamental Concepts
Summary
The present paper intends to analyse the Romanian fiscal system under its
most important aspects, starting with its concept of budgetary system, its composing
elements, the report between the budgetary and the fiscal system and, not at last,
the fundamental concepts of the notions of duty, tax and contribution, as well as
those aspects resembling them, but mostly the ones that definitively distinguish
them.
We find important not only the specification of these concepts, but mainly the
fact that, through their correct delimitation, it is also realized the determination of
the whole they compose, the Romanian fiscal system.
1. Satisfacerea nevoilor generale ale societãţii, incluzând în acestea atât nevoile
individuale, cât mai ales pe acelea colective, este condiţionatã fundamental de
existenţa fondurilor bãneşti chemate sã asigure resursele financiare necesare
procurãrii tuturor acelor bunuri şi servicii ce compun ceea ce specialiştii au numit
nevoi publice.
O parte semnificativã a acestor fonduri sunt puse la dispoziţia autoritãţilor publice,
atât a celor centrale, cât şi a celor locale, pentru a asigura satisfacerea nevoilor
publice de interes naţional şi local.
Aceste fonduri publice se constituie pe seama transferului de valoare, respectiv
de putere de cumpãrare de la diverse persoane fizice şi juridice cãtre autoritãţile
publice. În felul acesta se formeazã fluxuri de resurse bãneşti în dublu sens. Pe de
o parte, existã fluxurile care alimenteazã fondurile publice, iar pe de altã parte, apar
fluxurile destinate satisfacerii nevoilor publice, indiferent dacã ele îmbracã forma
necesitãţii realizãrii funcţiilor statului, ori a unor servicii publice de interes naţional
sau local.

The Right to a Healthy Environment in the Case Law of the European Court of Human Rights
Summary
By recognising the right to a healthy environment as „protected par ricochet” by Article 8 of the Convention, the European Court set forth the principle that the States have, in this matter, essentially positive obligations to take measures to protect the persons against serious breaches of the environment protection, including in the relationships between private persons. One of these obligations, underlined in the Guerra case is the one to inform the persons about the serious risks of pollution due to an activity dangerous to the environment. The States must also ensure a fair balance between these rights of the persons and a public interest, such as that of ensuring the economic well-being of the country.
§1. Poluarea fonicã
Una din cele mai interesante construcţii jurisprudenţiale ale Curţii Europene a
Drepturilor Omului este includerea dreptului la un mediu sãnãtos în sfera protecţiei
vieţii private. Într-o primã etapã, reprezentatã de hotãrârile în cauzele Powell şi
Rayner c/ Regatului Unit (1990) şi Baggs c/ Regatului Unit (1987), Comisia şi Curtea
au considerat cã poluarea sonorã datoratã exploatãrii unui aeroport în vecinãtatea

În Powell şi Rayner, reclamanţii, ale cãror locuinţe erau situate în apropierea
aeroportului Heathrow din Londra, chiar sub traseele de zbor, au pretins cã dreptul
lor la respectul vieţii private, mai precis calitatea vieţii şi dreptul de a se bucura de
domiciliul lor, au fost afectate de zgomotul produs de avioane. Curtea a admis
importanţa economicã majorã a aeroportului Heathrow, arãtând cã existenţa
aeroporturilor internaţionale în zone urbane dens populate a devenit o necesitate
pentru bunãstarea economicã a ţãrii. De asemenea, Curtea a mai observat cã unele
mãsuri fuseserã luate pentru a diminua lipsa confortului populaţiei afectate de aceste
activitãţi: restricţii impuse pentru zborurile de noapte, monitorizarea nivelului de
zgomot al aparatelor de zbor, izolarea fonicã a peste 16.000 de locuinţe, etc. Luând
în considerare toate acestea, Curtea a decis cã „nu existã motive serioase pentru a
susţine cã atât politica economicã în acest domeniu, cât şi conţinutul mãsurilor
speciale luate de Regatul Unit ar da naştere unei violãri a articolului 8 al Convenţiei”.

The Muslims and Human Rights. Challenges and Perspectives in the Muslim Countries and in the Western States
Summary
This study aims to answer three questions: which are the reasons of the
challenges created to the Muslim society by Human Rights, which are the fields
of these challenges and how to solve these challenges. Human Rights create
these challenges vis-à-vis the Muslims because of their specific conception on
the law, which is similar to the Jewish one, but different from the Christian one.
These problems raise debates in the Muslim countries as well as in the non-
Muslim countries interested in the rising of the Muslim integrism and in Human
Rights violations.
Notre étude vise à répondre à trois questions: quelles sont les raisons des défis
que les droits de l’homme posent aux musulmans, quelles sont les domaines des
défis et comment résoudre ces défis2.
I. Raisons des défis: conception différente de la loi
Les droits de l’homme posent des défis aux musulmans en raison de la conception
qu’ils ont de la loi, conception qu’ils partagent avec les juifs, mais qui diffère de
celle des chrétiens. Voyons les trois conceptions par ordre chronologique.

The Evaluation Report Elaborated by the Victims’ Protection and Social Reintegration Services
Summary
In the majority of cases, the evaluation report is requested by the court of first
instance, considering that at this level it is appropriate to reflect the
individualization of the punishment. All these reports could be valued by the
Court as real instruments for the legal individualization of the punishment, referring
also to art.72 and art.100 The Criminal Code.
Therefore, we consider that the evaluation report made by the Victim Protection
and Social Reintegration Service has several concrete purposes:
- assisting the court to characterize and individuate a punishment,
- assisting the judicial organs in taking decisions concerning the replacement,
suspension, or enforcing the special protection measures provided by the Law
no.272/2004 for the crimes committed by the minors who do not have criminal
responsibility.
- assisting the court in analyzing the request for rehabilitation.
- assisting the court in taking decisions regarding the postponing the
enforcement of the punishment.
- Avoiding taking the decision for the extension of the temporary preventive
detention measure, or avoiding enforcing the temporary preventive detention for
the accused.
The Evaluation Report comprises the following parts:
a) introductory part
b) the information resources used for the briefing. All these sources of
information shall mention all the persons who have been questioned or seen,
and also all the documents that have been consulted. There will be mentioned all
the meetings had, the intention of cooperation, or the refusal, if the case, and also
there should be indicated the documents that were not possible to be seen.
c) information regarding the person for whom the evaluation is made.
d) all the factors that could influence the behaviour of the person.
e) the future perspectives of the social reintegration.

The Procedure of Evidence Administration in Civil and Commercial Cases in the EU Member States, in the Light of the Regulation (CE) no. 1206/2001
Summary
The well functioning of EU internal market determined an improved, simplified and accelerated juridical cooperation in obtaining evidence between the courts of the member states. The no. 1206/2001 EC Regulation on cooperation between the national courts in the field of evidence in civil and commercial maters helps the courts administer the evidence found on the territory of the member states and ensures adherence to the direct mediation principle; the procedure concerning evidence gathering is provided by the law of the solicited state. The cooperation between the courts of the Member States is based on the principle of reciprocal trust, which consists of acknowledging the lawful order of the respective states. Evidence is a “central institution” in the civil process. The EC Regulation ensures timely gathering of evidence as well as solving the civil/commercial causes in a reasonable time frame. In this activity, the judiciary atlas is of great help to magistrates. It offers information on the court competent to receive the request, the way documents are communicated and how evidence can be obtained.

Prin semnarea, la data de 7 februarie 1992, a Tratatului de la Maastricht privind
instituirea Uniunii Europene, s-a urmãrit, printre altele, dezvoltarea unei mai bune
cooperãri în domeniul justiţiei şi afacerilor interne, în scopul asigurãrii siguranţei şi

L’identification criminalistique par la méthode A.D.N. (II)
Résumé
Nous avons affirmé, dans la première partie de l’étude, l’importance de la
technique des empreintes génétiques et ses conséquences sur l’activité des
organes d’enquête.
Il faut remarquer, le même temps, que les progrès de la biologie et de la
médicine bouleversent les règles morales, et aussi les normes juridiques. C’est
la bioéthique (entendu comme liason entre la science et les droits de l’homme)
qui impose de nouvelles réglementations, adaptées aux nouvelles réalitées.
Donc, toute discussion sur l’analyse de l’A.D.N. est étroitement liée à la
protection des droits et des libertés fondamentales – droit de disposition sur son
propre corp, droit à la vie privée, protection des données personnelles. Le
législateur national a une difficile mission, parce-qu’il doit concilier la tradition
juridique, les innovations de la science et la protection des droits de l’homme. Il
faut légiférer dans le système juridique roumain, car l’utilité et la fiabilité des
résultats recommandent cette méthode comme un véritable moyen de preuve.
„Avem în mâini un instrument care permite sã se dovedeascã, aproape sigur,
culpabilitatea sau nevinovãţia unui suspect. Unicitatea persoanei e doveditã printr-o
picãturã de sânge, un fir de pãr, o unghie – etalatã sub forma unui cod de bare.
Analiza prin tehnica amprentelor genetice priveşte A.D.N.-ul. Aceastã moleculã se
aflã în majoritatea celulelor. Pentru ca analiza sã fie realizatã corect, trebuie ca
integritatea acestei molecule sã fie pãstratã”1.
Aceastã aserţiune condenseazã la maximum importanţa tipãrii A.D.N. în procesul
penal. Am afirmat, într-o primã parte a studiului2, utilitatea acestei metode,
repercusiunile ei asupra demersului organelor de cercetare penalã şi necesitatea
consacrãrii sale într-o viitoare reglementare de gen. Discuţiile privind profilul genetic
nu se pot dispensa însã, nici un moment, de imperativul protejãrii drepturilor
fundamentale, ştiut fiind cã tehnologiile moderne, din ce în ce mai subtile şi mai
sofisticate, sunt forme potenţiale de ameninţare a libertãţii şi demnitãţii persoanei.
Ne vom apleca, în cele ce urmeazã, asupra relaţiei dintre utilizarea tehnicii A.D.N. –
ca instrument la îndemâna specialiştilor criminalişti – şi problemele de naturã bioeticã.

Some Remarks on the Legislative Delegation in Comparative Constitutional Law
Summary
The notion of delegation is a foundational concept in modern legal theory,
since and to the extent that – according to a given theoretical standpoint and within
a given historical paradigm – it inevitably serves as a ‘metaphorical’ placeholder
for the essential normative assumptions regarding law and law-making. To wit,
contemporary delegation debates are often theoretical proxies for larger
discussions on legitimacy, representation, accountability, rule of law, separation
of powers, and the proper scope of state power.
The modern phenomenon of legislative delegations and its implications for
constitutionalism as such and for specific constitutional systems in particular
have given rise to a vast body of doctrinal attempts at conceptualization and
various realignments of constitutional practices. In terms of practices, different
constitutional systems have adopted, over time, a number of constitutional and
sub-constitutional limitations through which subordinate (delegated) law-making
could be checked and, thus, reconciled with the foundational assumptions
underlying limited government.
This article examines the essential constitutional (and constitutionalist) problem
raised by delegation, namely that of a limitation on the legislation, which in turns
reflects normative assumptions regarding legislation as such. For these
assumptions the term ‘delegation’ stands as a placeholder or metaphorical
shorthand. Our current usage of the delegation ‘metaphor’ is unavoidable; the
normative limitation on legislation reflects the limitation on government as a whole,
which characterizes (as a matter of theory) a given normative account or (in terms
of practices) a certain constitutional system or a given historical stage. The failure
to grapple with the various legislation-related conceptual strands shorthanded
by the notion of ‘delegation’ often leads to confusion and doctrinal and
jurisprudential debates at cross-purposes.
The present study is an incipient attempt at clarification. A better conceptual
framework will hopefully lead, in turn, to a better grasp of the phenomenon and a
better identification and clearer understanding of the relevant tensions in
contemporary constitutional and administrative law.

Summary
The freedom of the press is a fundamental issue in every democratic state, so
that the information meant to reach the public should be real. If pressures are
exerted on press, then the transmitted information will lack objectivity.
The role of the press is that of taking into discussion certain problems, which,
generally, concern the society. In this way, the public becomes aware of certain
facts within the society and can make their own opinions and convictions, exerting
pressures on the decision factors, obviously with the purpose of complying these
factors’ action with the general interest.
Despite all these, there is no total or absolute freedom of expression. This fact
supposes that in certain situations the freedom of expression can be restrained,
if this is legitimate and justified. This possibility comes when two rights, which are
equally protected by law, are taken into discussion.
Libertatea presei este fundamentalã în orice stat democratic, pentru ca informaţiile
care ajung la public sã fie reale. Dacã asupra presei se exercitã presiuni, informaţia
transmisã îşi va pierde din obiectivitate.
Rolul presei este acela de a pune în discuţie anumite probleme, care intereseazã
societatea în general. În acest mod, publicul cunoaşte anumite realitãţi sociale şi îşi
poate forma propriile opinii şi convingeri, exercitând presiuni asupra factorilor de
decizie, evident în scopul armonizãrii acţiunii acestora cu interesul general.
Cu toate acestea, nu existã o libertate totalã sau o libertate absolutã de exprimare.
Acest lucru presupune cã, în anumite situaţii, libertatea de exprimare poate fi
restrânsã, dacã acest lucru este legitim şi justificat. Aceastã posibilitate intervine
atunci când intrã în discuţie douã drepturi care se bucurã, în egalã mãsurã, de
protecţia legii.
Evenimentele petrecute în anul 1989 au generat în România o puternicã schimbare
de atitudine, caracterizatã printr-o permanentã tendinţã de reafirmare a drepturilor şi

REZUMATUL
High broadband Internet access for all, on the whole territory with accessible costs, constitutes an essential stake, both for the attractivity of a specific territory and also for the development of innovating industries. One of the solutions adopted in order to allow the high cover of the territory is the wireless local loop (BLR). The question of the spectrum management follows a double interest: to develop competition and to ensure the cover of the territory. The topicality of the subject makes possible to observe its results concerning the liberalization of the electronic communications sector and provides a good occasion to reconsider the rules applicable to the operators in the resource allocation in Wireless Multimedia Networks. Indeed, the recent end of networks specialisation alters the reflexion on the legal framework applicable to different networks providing the same services. Moreover, the existence of a increasing request to use the radioelectric spectrum in several sectors such as telecommunications, transport or public safety clarifies the lack of effectiveness of the current methods regarding the attribution of frequencies and licences. The right of the frequencies becomes a right to the whole share and the frequences were regarded as integral part of the public domain. However, they remain subjected to rules to which the mode of the domaniality is unaware of. The right of the frequencies is made, on one hand, of a legal base drawn from the Code of Stations and Electronic Communications, and on the other hand, of an original Praetorian drawing.
L’accès à l’internet à haut débit pour tous, sur l’ensemble du territoire national à un coût abordable, constitue un enjeu essentiel. Résumé
Le secret de la messagerie électronique, le droit à l’intimité virtuelle et la
protection des données personnelles – sont les trois aspects de la protection de
la vie privée qu’on rencontre dans le contexte normatif de l’Internet. La première
partie de l’étude a eu comme objet la confidentialité de la messagerie électronique.
On s’occupera, dans cette partie, des autres deux facettes qui donnent du contour
à la sphère privée de l’internaute.
Lorsqu’il se connecte à l’Internet, l’individu est souvent appelé à se dessaisir
d’informations le concernant. Or, il peut en être fait un usage dont il n’aura pas
toujours conscience. Ainsi, les informations dévoilées permettent l’intrusion dans
l’intimité de l’internaute. S’il est un salarié, on peut mettre en discussion le régime
de l’Internet dans l’entreprise. Les solutions doivent satisfaire l’intérêt de
l’employeur, et aussi l’intérêt du salarié.
Un paquet législatif a réglementé, en commençant avec 2001, le problème
des données personnelles. La Loi nş677/2001 et la Loi nş506/2004 ont consacré
les droits et les libertés des personnes concernées par les données qui vont être
traitées. Les principes généraux sont bien applicables à l’Internet, même s’il
n’existe pas, à proprement parler, un système juridique de protection des
informations personnelles spécifique au réseau virtuel.
Trei dintre aspectele dreptului la viaţã privatã se regãsesc în actualul context normativ al Internetului: secretul poştei electronice, dreptul la intimitate virtualã şi, în strânsã relaţie cu acestea, protecţia datelor personale. Pãstrarea confidenţialitãţii mesageriei electronice a fãcut obiectul primei pãrţi a studiului1; vom dezvolta, în cele ce urmeazã, celelalte douã faţete, care dau contur sferei vieţii private a internautului.
